About these terms

These Terms of Service govern your use of sthuthi.art and any order, commission enquiry or other interaction with Sthuthi Art. By using the website or placing an order, you agree to these terms. If you do not agree, please do not use the website.

Eligibility and accounts

You must be legally able to enter a binding contract in your jurisdiction. You are responsible for accurate account information, safeguarding your sign-in credentials and activity under your account. We may suspend access where reasonably necessary to protect the website, customers or the studio.

Artwork, sizes and availability

Product pages describe the artist, imagery, medium, dimensions and available size tier for each work. Screens and photography can render colour, surface and scale differently from the physical piece. Dimensions are controlling when assessing fit.

Works offered in multiple sizes are produced to the selected specifications. Enquiry-only commissions are not available for direct checkout and require written agreement on scope. We may correct genuine catalog errors, decline an order or cancel an unavailable item; if payment was collected, the affected amount will be refunded.

Orders and payment

An order is an offer to purchase. Acceptance occurs when Sthuthi Art confirms the order. Prices are displayed in USD; optional currency conversions are estimates, and payment is charged in USD. Payment processing is provided by Stripe. Applicable taxes are calculated at checkout where supported.

Insured shipping is charged per product based on your delivery destination and is shown at checkout before payment. Shipping, returns and refunds are also governed by the linked Shipping Policy and Returns & Refunds Policy.

Commissions

A commission enquiry does not create an obligation for either party. A commission begins only after the studio and collector agree in writing to the brief, materials, dimensions, price, payment schedule and other project-specific terms. Bespoke commissions may have cancellation and return terms different from ready-to-order works; those terms will be disclosed before payment.

Intellectual property

Artwork, photographs, video, text, logos, 3D models and website design remain protected by copyright, trademark and other laws. Buying a physical work transfers ownership of that object only. It does not transfer copyright or permit reproduction, merchandising, tokenisation, commercial display or creation of derivative works without written permission from the relevant rights holder.

Acceptable use

• Do not misuse the website, interfere with security or attempt unauthorised access.
• Do not scrape, reproduce or commercially exploit catalog material without written permission.
• Do not submit unlawful, abusive, deceptive or rights-infringing content.
• Do not use automated systems in a way that burdens or disrupts the service.

Third-party services

The website uses third-party services for payment, authentication, email delivery and other operations. Their services may be subject to their own terms and privacy notices. Links to external websites are provided for convenience; Sthuthi Art does not control their content or availability.

Disclaimers and liability

The website is provided on an as-available basis. To the extent permitted by law, Sthuthi Art disclaims implied warranties not expressly stated here and is not liable for indirect, incidental, special or consequential loss arising from website use. Nothing in these terms excludes liability or remedies that cannot lawfully be excluded, including applicable statutory consumer rights.

Indemnity

To the extent permitted by law, you agree to indemnify Sthuthi Art from third-party claims caused by your unlawful misuse of the website or infringement of another person's rights. This does not apply to claims caused by Sthuthi Art's own unlawful conduct.

Governing law and disputes

These terms are governed by the laws applicable in Delaware, United States, without regard to conflict-of-law rules. Courts with jurisdiction in Delaware may hear disputes, except where mandatory consumer law gives you the right to bring a claim elsewhere. Please contact the studio first so we can try to resolve any concern promptly.

Changes

We may update these terms to reflect legal, operational or service changes. The effective date above identifies the current version. Material changes apply prospectively unless law requires otherwise.
